The Fair Housing Act — what it protects

The Federal Fair Housing Act (42 U.S.C. §§ 3601–3619) prohibits discrimination in the sale, rental, financing, and advertising of housing based on the following protected classes:

No person may be denied housing, shown different properties, or treated differently in any housing transaction based on race.

🎨 Color

Discrimination based on the color of a person's skin is prohibited in all housing transactions and advertising.

⛪ Religion

Housing decisions cannot be made based on a person's religion or religious practices.

⚧ Sex

Includes gender identity and sexual orientation under current HUD interpretation and NC state law.

♿ Disability / Handicap

Persons with physical or mental disabilities are protected. Reasonable accommodations and modifications must be provided.

👨‍👩‍👧 Familial Status

Families with children under 18 cannot be discriminated against. Includes pregnant women and those seeking custody of children.

🌍 National Origin

Discrimination based on a person's country of birth, ancestry, or ethnicity is prohibited.

🎖️ Military Status (NC)

North Carolina state law adds military status as a protected class in housing transactions.

North Carolina law (G.S. Chapter 41A) mirrors the Federal Fair Housing Act and adds military status as an additional protected class.
